Entity: APS ECOM SOLUTIONS, LLC (“Company,” “we,” “us,” “our”)

These Terms & Conditions (“Terms”) govern your access to and use of the Manifesting Bestie mobile application, website, content, and related digital services (collectively, the “Services”). These Terms are intended to be exhaustive, comprehensive, and protective of the Company’s interests.

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

These Terms apply worldwide, regardless of the country or territory from which the Services are accessed.

1. DEFINITIONS

For purposes of these Terms:

  • “User,” “you,” “your” means any individual or entity accessing the Services.
  • “Content” means all text, audio, video, graphics, materials, meditations, recordings, images, artwork, interfaces, messages, journaling entries, and other data provided or generated by the user or the Company.
  • “Paid Services” means subscription features available through Apple App Store or Google Play Store.
  • “User-Generated Content” (UGC) means any content submitted by you, including journaling entries, reflections, notes, text inputs, images (if applicable), or other data.
  • “AWS” refers to Amazon Web Services, our infrastructure provider.

2. ACCEPTANCE OF TERMS

  • Agree to be bound by these Terms
  • Acknowledge the Privacy Policy
  • Affirm you are legally capable of entering binding agreements
  • Consent to electronic communications
  • Agree that your use is voluntary and at your own risk

If you do not agree, please cease use immediately.

3. ELIGIBILITY

  • Be at least 18 years old
  • Have legal capacity to enter into agreements
  • Use the Services in compliance with all applicable laws

4. ACCOUNT REGISTRATION

  • Provide accurate, complete information
  • Maintain confidentiality of login credentials
  • Immediately notify us of unauthorized access
  • Accept all responsibility for activity occurring under your account

The Company is not liable for losses resulting from unauthorized access or compromised credentials.

5. SUBSCRIPTIONS, BILLING, AND PAYMENT TERMS

5.1 Subscription Plans

Monthly Subscription – 1-month auto-renewable subscription billed at USD $79.00 per month

Yearly Subscription – 12-month auto-renewable subscription billed at USD $790.00 per year

Prices may vary by region and are subject to change as permitted by applicable law.

5.2 Billing & Auto-Renewal

Payment will be charged to your Apple ID account (or Google Play account) at confirmation of purchase.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the applicable subscription rate.

5.3 Managing or Canceling Subscriptions

You may manage or cancel your subscription at any time by going to your App Store or Google Play account settings after purchase.

Deleting the app does not cancel your subscription.

5.4 Refunds

All purchases are processed through Apple App Store or Google Play Store.

Refunds are handled exclusively by the respective app store and are subject to their policies.

The Company does not process refunds directly.

6. USER-GENERATED CONTENT (INCLUDING JOURNALING)

  • You voluntarily choose what to write
  • You retain ownership of your UGC
  • You grant the Company a limited, revocable license to store, process, and display such content internally to provide Services
  • You assume all risks associated with entering sensitive information
  • You understand and accept inherent risks of cloud storage on AWS
  • You agree not to submit illegal, defamatory, or harmful material
  • The Company makes no guarantee regarding the security or confidentiality of UGC, including journaling content.

7. STORAGE & DATA SECURITY DISCLAIMERS

  • No system is immune to breaches
  • Unauthorized access, interception, alteration, corruption, or loss of data may occur
  • You assume all risks associated with cloud infrastructure
  • The Company is not liable for loss of journaling entries or any UGC
  • If you do not wish to risk potential exposure, do not enter sensitive information into the Services.

8. INTELLECTUAL PROPERTY RIGHTS

  • U.S. copyright laws
  • International copyright conventions
  • Trademark laws
  • Intellectual property rights treaties

9. LICENSE GRANT

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for personal, non-commercial use.

10. PROHIBITED CONDUCT

  • Use the Services for illegal, harmful, or abusive purposes
  • Attempt unauthorized access to systems or accounts
  • Use bots, scrapers, or automated systems
  • Circumvent digital rights management
  • Interfere with function or security
  • Exploit bugs or vulnerabilities
  • Upload malware or malicious content

11. NO MEDICAL, PSYCHOLOGICAL, OR PROFESSIONAL ADVICE

The Services provide motivational content, meditation tracks, self-help resources, spiritual and manifestation guidance.

12. RESULTS DISCLAIMER

Manifestation outcomes vary by individual. Results are not guaranteed.

13. THIRD-PARTY SERVICES & INTEGRATIONS

The Services may integrate with third-party providers including AWS, analytics tools, app stores, and authentication providers.

14. SERVICE MODIFICATIONS

We may alter, modify, suspend, or discontinue any feature at any time.

15. TERMINATION

We may suspend or terminate your account with or without notice.

16. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

17. LIMITATION OF LIABILITY

APS ECOM SOLUTIONS, LLC is not liable for damages arising from use of the Services.

18. INDEMNIFICATION

You agree to indemnify and hold harmless APS ECOM SOLUTIONS, LLC.

19. GOVERNING LAW & JURISDICTION

Governed by the laws of the State of Florida, United States.

20. ARBITRATION AGREEMENT

Disputes resolved through binding arbitration under AAA rules.

21. CLASS ACTION WAIVER

No class or group actions permitted.

22. CHANGES TO TERMS

We may modify these Terms at any time.

23. SEVERABILITY

If any provision is invalid, remaining provisions remain in effect.

24. ENTIRE AGREEMENT

These Terms constitute the entire agreement.
